1Introduction

Peck Realty of Daytona Beach, Inc. ("Peck Realty," "we," "us," or "our") is a licensed Florida real estate brokerage located at 2430 South Atlantic Avenue, Suite E, Daytona Beach Shores, Florida 32118. We have served the Daytona Beach market since 1969, offering condominium sales, leasing, vacation and long term rentals, and rental property management.

This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit peckrealty.com (the "Website") or otherwise interact with us online. It also describes the rights available to you under United States federal and state law, the European Union and United Kingdom General Data Protection Regulations, and Canadian privacy law.

Please read this policy carefully. By using the Website, you acknowledge that you have read and understood it. If you do not agree with our practices, please do not use the Website.

2Scope of This Policy

This policy applies to personal information collected through the Website and through electronic communications initiated from the Website.

This policy does not apply to:

  • Information collected offline, by telephone, or in person, except where that information is later entered into systems described here
  • Information you provide directly to third party booking platforms such as Airbnb or Vrbo, which operate under their own privacy policies
  • Information collected by owners, property managers, condominium associations, or other third parties with whom you may separately contract
  • Information governed by a separate written agreement between you and Peck Realty, such as a listing agreement, lease, or purchase contract, where that agreement addresses privacy

3Information We Collect

3.1 Information You Provide Directly

When you submit an inquiry through a form on the Website, or contact us by email through the Website, we may collect:

  • Identifiers: your first and last name, email address, telephone number, and postal address or general location if you choose to provide it
  • Inquiry content: the property or properties you are interested in, your intended dates of interest, whether you are seeking to buy, sell, rent, or lease, your general budget range if you choose to share it, and any free text message you write to us
  • Communication preferences: whether you have consented to receive marketing communications by email, telephone, or text message
  • Correspondence: the content of emails and messages you send us and our replies

You are not required to provide any of this information, but if you do not provide your contact details we will not be able to respond to your inquiry.

3.2 Information Collected Automatically

When you visit the Website, certain information is collected automatically by our hosting platform and any analytics tools we use:

  • Device and browser information: IP address, browser type and version, operating system, device type, and screen resolution
  • Usage information: pages viewed, time spent on pages, referring website or search engine, links clicked, and the date and time of your visit
  • Approximate location: a general geographic region derived from your IP address, typically at the city or region level, not a precise location

We do not collect precise geolocation data.

3.3 Information From Third Parties

We may receive limited information from:

  • Third party listing and booking platforms, where you have contacted us through them
  • Service providers who help us detect and prevent spam or fraudulent form submissions
  • Publicly available sources, such as public property records, where relevant to a specific inquiry

3.4 Information We Do Not Collect Through the Website

We do not collect the following through the Website:

  • Social Security numbers or other government identification numbers
  • Credit card, debit card, or bank account numbers
  • Credit reports, credit scores, or consumer reports
  • Rental applications, tenant screening data, or background check information
  • Biometric identifiers or facial recognition data
  • Precise geolocation data
  • Racial or ethnic origin, religious beliefs, health information, sexual orientation, immigration status, union membership, or other sensitive categories

The Website does not process payments and does not accept rental applications online. Reservations are arranged by telephone or through independent third party platforms.

If we ever begin collecting any of the categories above, we will update this policy and, where the law requires it, obtain your consent first.

4How We Use Your Information

We use the information described above for the following purposes:

PurposeDescription
Responding to inquiriesTo answer your questions about properties, availability, pricing, and our services
Providing servicesTo connect you with the appropriate sales associate or rental agent
Follow up communicationsTo follow up on an inquiry you initiated, where permitted by law and your stated preferences
MarketingTo send newsletters, property updates, or promotional material, only where you have opted in and only until you opt out
Website operationTo host, maintain, secure, and improve the Website
AnalyticsTo understand aggregate traffic patterns and improve site content and structure
Security and fraud preventionTo detect spam submissions, abuse, and unauthorized access
Legal complianceTo comply with real estate licensing, recordkeeping, tax, and other legal obligations
Dispute resolutionTo establish, exercise, or defend legal claims

We do not use your information to make automated decisions that produce legal or similarly significant effects concerning you. See Section 6.

5Legal Bases for Processing (EEA, United Kingdom, and Switzerland)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, we process your personal data on the following legal bases under Article 6 of the GDPR and UK GDPR:

  • Consent (Article 6(1)(a)): for marketing communications, for non essential cookies, and for any processing where we have specifically asked for your permission. You may withdraw consent at any time.
  • Performance of a contract or pre contractual steps (Article 6(1)(b)): to respond to an inquiry you initiated, and to take steps at your request prior to entering into a rental, lease, listing, or purchase arrangement.
  • Legitimate interests (Article 6(1)(f)): to operate and secure the Website, to prevent fraud and abuse, to understand aggregate site usage, and to conduct ordinary business administration. We have assessed that these interests are not overridden by your rights and freedoms. You may object to this processing at any time.
  • Legal obligation (Article 6(1)(c)): to comply with recordkeeping, licensing, tax, and other legal requirements applicable to a Florida real estate brokerage.

We do not process special category data under Article 9 through the Website.

6Artificial Intelligence and Automated Processing

We use artificial intelligence tools to help our team handle inquiries efficiently. We believe you should understand exactly how this works.

6.1 What the AI Does

When you submit a form on the Website, the contents of that submission are transmitted to an automation service, Zapier, Inc., which we use to route inquiries to our team. As part of that workflow, Zapier passes the submission to an artificial intelligence model operated by OpenAI, L.L.C. (currently GPT-5.4 Mini) under Zapier's own commercial arrangement with that provider. The AI is used to:

  • Summarize and format your inquiry so our agents can review it quickly
  • Draft a suggested reply for a human agent to review

6.2 What the AI Does Not Do

The AI does not:

  • Make any decision about whether you will be shown a property, offered a rental, offered a lease, or offered a purchase opportunity
  • Score, rank, rate, or qualify you as a prospect
  • Determine pricing, terms, or availability
  • Send any communication to you automatically

Every reply you receive from Peck Realty is reviewed and approved by a human being before it is sent. No AI generated message is sent to you without human review.

6.3 No Automated Decision Making

Consistent with Article 22 of the GDPR and UK GDPR, and with the profiling opt out provisions of United States state privacy laws, we confirm that we do not subject you to decisions based solely on automated processing, including profiling, that produce legal effects concerning you or similarly significantly affect you. Housing decisions at Peck Realty are made by licensed human professionals.

6.4 Data Handling by the AI Provider

Our AI processing works as follows:

  • Zapier, Inc. acts as our processor and is bound by a written data processing agreement requiring it to process personal data only on our instructions
  • OpenAI, L.L.C. acts as a sub processor engaged by Zapier, reached through Zapier's commercial business account rather than a consumer product
  • Submissions are retained only for the limited period necessary for service operation, abuse monitoring, and legal compliance, after which they are deleted
  • We use a specific, fixed model rather than an automatic selection, so that we can tell you accurately which provider receives your data

Zapier's privacy policy is available at zapier.com/privacy, its sub processor list at zapier.com/legal/subprocessors, and OpenAI's privacy policy at openai.com/policies/privacy-policy.

If we change the model or provider used in this workflow, we will update this policy.

6.5 Your Right to Object

If you prefer that your inquiry not be processed using AI tools, contact us at sales@peckrealty.com or simply telephone us at (386) 257-5000. We will handle your inquiry manually. Declining AI processing will not affect the service you receive from us in any way.

7Cookies and Similar Technologies

7.1 What We Use

The Website uses strictly necessary cookies only.

Strictly necessary cookies are those required for the Website to function, including security, load balancing, and basic session management. They are set by our hosting provider, Framer B.V., in the course of delivering the Website to your browser.

We do not use:

  • Analytics or performance cookies
  • Advertising, retargeting, or conversion tracking pixels
  • Social media tracking pixels
  • Cross context behavioral advertising technologies
  • Any cookie that builds a profile of you across websites

Because we set only strictly necessary cookies, no consent banner is required under the EU ePrivacy Directive, the UK Privacy and Electronic Communications Regulations, or United States state privacy law.

If we add analytics or any other non essential technology in the future, we will update this policy and, where required, present a consent banner allowing you to accept or reject non essential cookies before they are set.

7.2 Managing Cookies

You may control or delete cookies through your browser settings. Because the Website uses only strictly necessary cookies, blocking them may prevent parts of the Website from working correctly.

7.3 Global Privacy Control and Do Not Track

We honor the Global Privacy Control ("GPC") signal. If your browser or extension transmits a GPC signal, we treat it as a valid request to opt out of any sale or sharing of personal information and of targeted advertising, in the jurisdictions where that is legally recognized.

There is no common industry standard for responding to browser "Do Not Track" signals. We do not currently respond to Do Not Track signals separately from GPC.

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. These include:

  • Encryption of data in transit using industry standard Transport Layer Security
  • Access controls limiting personal information to personnel who need it

No method of transmission over the internet or method of electronic storage is completely secure. While we work to protect your information, we cannot guarantee absolute security. You transmit information to us at your own risk.

12International Data Transfers

Peck Realty is located in the United States, and our service providers are located in the United States and elsewhere. If you are located outside the United States, your personal information will be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your country.

Where we transfer personal data out of the European Economic Area, the United Kingdom, or Switzerland, we rely on one or more of the following safeguards:

  • The European Commission's Standard Contractual Clauses adopted under Implementing Decision (EU) 2021/914
  • The United Kingdom International Data Transfer Addendum or the UK International Data Transfer Agreement
  • The Swiss Addendum to the Standard Contractual Clauses
  • The EU-U.S. Data Privacy Framework, the UK Extension, or the Swiss-U.S. Data Privacy Framework, where the recipient is certified
  • Your explicit consent, where no other mechanism applies and the transfer is occasional

You may request a copy of the relevant safeguards by contacting us at sales@peckrealty.com.

13Your Privacy Rights

13.1 Rights Available to Everyone

Regardless of where you live, you may:

  • Ask us what personal information we hold about you
  • Ask us to correct inaccurate information
  • Ask us to delete your information
  • Ask us to stop sending you marketing communications
  • Ask us not to process your inquiry using AI tools

We extend these rights to all users voluntarily, whether or not a specific statute requires it.

13.2 United States State Privacy Rights

Residents of states with comprehensive consumer privacy laws, currently including California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Delaware, Nebraska, New Hampshire, New Jersey, Minnesota, Tennessee, Maryland, Indiana, Kentucky, Rhode Island, and Pennsylvania, may have the following rights:

  • Right to non discrimination: we will not deny you services, charge you a different price, or provide a different level of service because you exercised a privacy right
  • Right to appeal: if we decline your request, you may appeal our decision. See Section 13.8.

13.5 Florida Residents

The Florida Digital Bill of Rights, Fla. Stat. 501.701 et seq., applies principally to businesses with more than one billion dollars in global gross annual revenue that meet additional platform based criteria. Peck Realty does not meet those thresholds and is therefore not a "controller" under that statute. We nonetheless extend the rights described in Section 13.2 to Florida residents as a matter of practice.

Peck Realty is subject to the Florida Information Protection Act, Fla. Stat. 501.171, which governs the security of personal information and requires notification in the event of a data breach. See Section 19.

  • Right to object (Article 21): object to processing based on legitimate interests, and object to direct marketing at any time and without justification
  • Right not to be subject to automated decision making (Article 22): as stated in Section 6.3, we do not carry out such processing
  • Right to withdraw consent (Article 7(3)): withdraw consent at any time, without affecting the lawfulness of processing carried out before withdrawal
  • Right to lodge a complaint: file a complaint with your national supervisory authority. In the United Kingdom this is the Information Commissioner's Office at ico.org.uk. In Switzerland this is the Federal Data Protection and Information Commissioner. A list of EEA supervisory authorities is maintained by the European Data Protection Board at edpb.europa.eu.

We will respond within one month of receiving your request, extendable by two further months where the request is complex, in which case we will inform you of the extension and the reasons for it.

EU and UK representative: Peck Realty's processing of EEA and UK personal data is occasional, does not involve large scale processing of special categories of data, and is unlikely to result in a risk to the rights and freedoms of individuals. We therefore rely on the exemption in Article 27(2) of the GDPR and UK GDPR and have not appointed a representative.

13.7 Canadian Residents

Under the Personal Information Protection and Electronic Documents Act ("PIPEDA") and applicable provincial legislation, you may request access to the personal information we hold about you, request correction of inaccuracies, and withdraw consent to our use or disclosure of that information, subject to legal and contractual restrictions and reasonable notice. Complaints may be directed to the Office of the Privacy Commissioner of Canada at priv.gc.ca.

Under Canada's Anti-Spam Legislation ("CASL"), we send commercial electronic messages to Canadian recipients only with express or implied consent, and every such message includes our identity, contact information, and a functioning unsubscribe mechanism.

13.8 How to Submit a Request

Submit any privacy request by:

  • Email: sales@peckrealty.com
  • Telephone: (386) 257-5000
  • Mail: Privacy Request, Peck Realty of Daytona Beach, Inc., 2430 South Atlantic Avenue, Suite E, Daytona Beach Shores, Florida 32118

Verification. To protect your information, we will verify your identity before acting on a request. We will typically ask you to confirm information already in our records, such as the email address or telephone number used to submit an inquiry. We will not create new accounts or collect additional sensitive information solely to verify you. If we cannot verify your identity, we will explain why and will not act on the request.

Timing. We respond to United States state law requests within forty five days, extendable once by an additional forty five days where reasonably necessary, and to GDPR and UK GDPR requests within one month as described in Section 13.6. Requests are free of charge unless they are manifestly unfounded or excessive, in which case we may charge a reasonable fee or decline, and will explain our reasoning.

Appeals. If we decline your request, you may appeal by replying to our decision with the subject line "Privacy Request Appeal" or by writing to the mailing address above. We will respond to the appeal within forty five days with a written explanation. If your appeal is denied, you may contact the Attorney General of your state. The Florida Attorney General may be reached at myfloridalegal.com.

14Marketing Communications and Your Choices

We honor unsubscribe requests promptly and in all cases within ten business days, as required by the CAN-SPAM Act. You will continue to receive transactional messages relating to an inquiry you initiated.

14.2 Telephone Calls and Text Messages

We contact you by telephone or text message only where you have given prior express written consent, or where the contact is a direct reply to an inquiry you initiated.

  • Consent to receive marketing calls or texts is never a condition of any purchase, rental, lease, or service.
  • Message and data rates may apply. Message frequency varies.
  • To stop text messages, reply STOP to any message. To request help, reply HELP.
  • We observe calling and texting hours of 8:00 a.m. to 8:00 p.m. in your local time, consistent with the Florida Telephone Solicitation Act, Fla. Stat. 501.059, and federal Telephone Consumer Protection Act requirements. Where federal and state rules differ, we apply the stricter standard.
  • We honor the National Do Not Call Registry and the Florida Do Not Call list.
  • We maintain records of consent, including the date, time, and the exact language you were shown at the time you opted in.

14.3 Withdrawing Consent

You may withdraw consent to any form of marketing at any time by using the unsubscribe link, replying STOP, or contacting us at sales@peckrealty.com. We will retain a minimal suppression record so that we do not contact you again.

15Children's Privacy

The Website is intended for adults aged eighteen and over. We do not knowingly collect personal information from anyone under eighteen.

Consistent with the Children's Online Privacy Protection Act ("COPPA") and with Fla. Stat. 501.1735, we do not knowingly collect, use, sell, or share the personal information of minors, and we do not profile minors or use their data for targeted advertising.

If you believe a minor has provided us with personal information, contact us at sales@peckrealty.com and we will delete it promptly.

16Third Party Websites and Booking Platforms

The Website contains links to third party websites, including short term rental platforms such as Airbnb and Vrbo, condominium association websites, and mapping services.

When you follow such a link, you leave our Website. We do not control and are not responsible for the privacy practices of those third parties. The information you provide to them is governed by their privacy policies, not ours. We encourage you to read those policies before providing any information.

17Fair Housing

Peck Realty is committed to the letter and the spirit of the Fair Housing Act, 42 U.S.C. 3601 et seq., the Florida Fair Housing Act, Fla. Stat. Chapter 760, Part II, and all applicable local ordinances.

We do not collect, request, infer, or use information about race, color, religion, sex, sexual orientation, gender identity, familial status, national origin, disability, or any other protected characteristic in connection with any inquiry, and we do not use any such information in deciding how to respond to you, which properties to show you, or what terms to offer.

As stated in Section 6.3, our AI tools do not evaluate, score, or make decisions about you.

18Accessibility of This Policy

If you require this policy in an alternative format, or need assistance exercising any right described here, contact us at sales@peckrealty.com or by telephone at (386) 257-5000 and we will accommodate your request.

19Data Breach Notification

In the event of a breach of security affecting personal information, we will notify affected individuals and, where required, the Florida Department of Legal Affairs, in accordance with the Florida Information Protection Act, Fla. Stat. 501.171, and any other applicable state or national breach notification law.

Where the GDPR or UK GDPR applies, we will notify the competent supervisory authority within seventy two hours of becoming aware of a personal data breach where required by Article 33, and will notify affected individuals without undue delay where required by Article 34.

20Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page.

If we make material changes to how we collect, use, or share personal information, we will provide prominent notice on the Website and, where required by law or where we have your contact details and the change affects you, by email. Where a change requires your consent, we will obtain it before the change takes effect.

Your continued use of the Website after an update takes effect constitutes acknowledgment of the revised policy.
